Introduction

Welcome to sawamgallery.com, the e-commerce and auction platform provided by FYN LLC under the Sawam Gallery brand. By using sawamgallery.com, you agree to these Terms & Conditions. All prices displayed include applicable VAT (5%). All products, auctions, and information constitute an "invitation to offer." For retail purchases, your order is your "offer," subject to acceptance upon dispatch. For auctions, your bid is your "offer," subject to the highest valid bid and seller acceptance. We reserve the right to accept or reject any offer. If you provide a valid email, we'll confirm receipt and dispatch details. No prior act constitutes acceptance.

Membership Eligibility

Use of the site is for persons who can form legally binding contracts under Omani law. Minors under 18 (but 13+) may use it only under parent/guardian supervision, who must agree to these terms. Parents/guardians of under-18s can transact if registered. Adult-only products (e.g., certain perfumes or accessories) are prohibited for minors. We may terminate access if you're under 18 or ineligible. Suspended/terminated users are barred. Businesses must have authority to bind the entity and provide valid VAT registration if applicable. Users outside Oman comply with local laws; we deliver only within Oman and aren't liable for external claims. These terms supersede prior agreements.

Account and Registration Obligations

"Your Information" includes registration, purchase, bid, or feedback data, protected per our Privacy Policy. Maintain confidentiality of your account/password; you're responsible for all activity. Notify us immediately of breaches. Provide accurate, current Registration Data (including VAT details for businesses) and update it promptly. False info may lead to suspension/termination without notice.

Pricing Information

All prices include 5% VAT as required by Omani law. We aim for accuracy, but errors occur. We can't confirm until order/bid acceptance. We may refuse/cancel erroneous orders pre-dispatch. For auctions, final price is winning bid plus fees and VAT. We'll contact you for instructions or cancel/refund (VAT-inclusive). Prices/availability change without notice; store prices may differ.

Auctions and Bidding

Bids are binding offers excluding VAT (added at checkout). Highest valid bid wins, subject to seller reserve/acceptance. We aren't liable for bid errors, shill bidding, or disputes. Winning bidders pay promptly (including VAT); non-payment forfeits the item. Auction items sold "as is" unless specified.

Delivery

Retail: 2-5 business days within Oman. Large electronics/bags: 5-7 days. Auctions: As specified per listing, typically 3-7 days post-payment. Delays from supplier/stock aren't our liability. VAT invoice provided with delivery.

Cancellation by Sawamgallery.com

We may cancel orders/auctions for stock limits, errors, fraud, or verification needs. We'll notify you and refund full amount including VAT (reversing charges; no cash).

Cancellations by Customer

Pre-processing cancellations get full refunds including VAT. Post-processing/shipped orders can't be canceled. Our decision is final.

Third-Party Products / Re-sellers / Auction Sellers

For items from third-party vendors/auction sellers: VAT applies as per Omani law. We don't control their performance or VAT compliance. No guarantees on quality/fulfillment. You indemnify us from vendor disputes.

Credit Card Details

Provide accurate, owned card details. We don't share unless legally required. You're liable for fraud; prove otherwise at your expense.

Fraudulent/Declined Transactions

We may recover costs/legal fees (plus VAT) from fraudsters and pursue proceedings.

Electronic Communications

You consent to electronic notices via email/site, satisfying legal writing requirements.

You Agree and Confirm

• Extra redelivery costs from your errors are yours (VAT applicable).
• Use site lawfully, provide true info (including VAT registration) - we verify.
• Transactions at your risk; check descriptions. VAT included in all prices.
• Prohibited: unlawful/harassing content, unauthorized access, IP infringement.
• Delivery address must be accurate.

Colors and Product Visuals

Colors/images are illustrative; actuals vary by device/region.

Shipping and Insurance

Costs based on weight, method, locations (VAT applicable). International buyers pay duties/taxes. Insure high-value items (watches, electronics).

Modification of Terms

We may update terms without notice. Continued use means acceptance. Check regularly.

Governing Law and Jurisdiction

Governed by Omani law including VAT regulations. Muscat courts have exclusive jurisdiction. Disputes go to arbitration in Muscat, appointed by FYN LLC—final and binding.

Reviews, Feedback, Submissions

Comments become our property (worldwide rights assigned). We may use/edit without compensation. No spam/illegal content; you indemnify us.

Objectionable Material

Site use at your risk; we aren't liable for offensive content.

Indemnity

You indemnify FYN LLC, Sawam Gallery, employees, and affiliates from claims due to your breaches/actions, including VAT disputes.

Termination

We may terminate access anytime without liability. Obligations survive.

Stock Status "On Demand" / Auctions

"On Demand" or auction items ordered post-payment; no stock guarantee. VAT applies.

Disclaimer

We may cancel for wrong image/price/description. All prices include VAT and are subject to change.

Entire Agreement

Invalid parts replaced to match intent; rest stands. No waivers. VAT compliance mandatory.

Orders Held/Delayed

Delays/holds from incomplete info (including VAT details) or bank flags.

Operating Days

Our business hours are Saturday to Thursday. Official public holidays and the first three days of Eid holidays are non-working days and are excluded from delivery calculations.

24/7 support is available via WhatsApp to assist with order and product inquiries.

Orders and Cancellations

Once payment is confirmed, orders cannot be modified. Cancellation is allowed only through the website before order processing begins. After shipping preparation has started or a label has been generated, the order is considered final and cannot be canceled.

Addresses

Customers must ensure accurate address information, including name, street, building or house number, area, and notable landmarks. Incorrect or incomplete addresses may result in delayed delivery or additional shipping fees.
